Hear an update from one of their lawyers after a three judge panel of
the appeals court threw out their convictions. Now the US government is
appealing the ruling to the full court.
Hear Rafael Rodriguez Cruz, a Puerto Rican attorney, practicing law in
Hartford, Connecticut who is actively involved in the campaign to free
the Cuban Five and for the visitation rights of their relatives. He is
also a freelance journalist who writes on political struggles in Latin
America. He travels frequently to Cuba, Venezuela and Argentina.

Ojedas in Puerto Rico last week.

Leonard Weinglass, an attorney for the defense, said that the appeal by
the U.S. attorney is an action that "has no adequate basis in legal
practice." He added, "The opinion that they [the prosecution] are trying
to challenge is the most extensive decision written on the theme of
venue (of a trial) in the history of the United States. They don't
consider the decision adequate, obviously for political reasons."
For their part, legal experts have recognized that the 3-judge decision
cites such an overwhelming amount of evidence, that there is nothing
that the prosecution can challenge factually.
Who are the Cuban Five? They are five Cuban men who are in U.S. prison
for simply defending their country of Cuba from terrorist acts by
extremist right-wing groups in Miami. They were sentenced from 15 years
to two life sentences. They never harmed anyone, yet they are in prison
while the anti-Cuba extremists whom they tried to stop are walking
freely in Miami. How did the five Cubans try to stop them? By monitoring
the terrorists' actions and informing Cuba of impending attacks by those
extremist groups. They were convicted in U.S. federal court on June 8,
2001 in a politically-charged trial: the U.S. government claimed they
were engaged in espionage on U.S. military bases and threatened
"national security." The espionage charge - and related charges - are a
complete fabrication. In 14,000 pages of transcript, no espionage
evidence was ever introduced.
